1. Who we are

This website, beyondthelabel.online (the "Site"), is operated by Beyond the Label, a training, coaching and advisory business run by Emma Strachan & Clare Mullane registered in the Netherlands.

We are the "data controller" responsible for your personal data. This means we decide how and why your personal data is used.

If you have any questions about this policy or how we handle your information, contact us at:

2. What this policy covers

This policy explains what personal data we collect when you use our Site, enquire about or receive coaching from us, or sign up to our mailing list; why we collect it; how we use and protect it; and the rights you have over it.

We are committed to protecting your privacy and handling your data in line with the UK General Data Protection Regulation (UK GDPR), the Data Protection Act 2018, and, where it applies to you, the EU General Data Protection Regulation (EU GDPR).

3. The personal data we collect

Depending on how you interact with us, we may collect:

Information you give us directly

  • Contact and enquiry details — your name, email address, phone number, and anything you choose to tell us when you complete a contact or booking form, book a call, or email us.

  • Booking and scheduling information — the date and time of sessions you book with us, via our scheduling tool.

  • Mailing list details — your name and email address if you subscribe to our newsletter or updates.

  • Client/company information — notes and information you share with us before or during the relationship so that we can support you effectively.

Sensitive ("special category") information

Because of the nature of our work, you may choose to share information about your health, mental health, wellbeing, neurodivergence (such as ADHD), or personal circumstances. Under data protection law this is "special category" data and is given extra protection. We only collect it where you actively provide it, and we handle it with particular care (see section 5).

Please only share sensitive information with us where you are comfortable doing so and where it is relevant to your coaching.

Information we collect automatically

  • Technical and usage data — when you visit the Site we, and our analytics provider, may collect information such as your IP address, browser type, device, the pages you visit and how long you spend on them. This is done through cookies and similar technologies (see section 8).

4. How and why we use your data (lawful bases)

Under UK/EU GDPR we must have a "lawful basis" for using your personal data. The table below sets out what we use your data for and the basis we rely on.

Where we rely on legitimate interests, we have considered whether those interests are overridden by your rights, and we believe they are not. You can ask us for more information about this at any time.

5. How we handle sensitive (special category) data

Where you share health, wellbeing or other special category information with us as part of coaching, we rely on the following conditions under Article 9 of the UK/EU GDPR:

  • Your explicit consent; and/or

  • That the processing relates to personal data you have manifestly made public, or is necessary for the establishment, exercise or defence of legal claims, where relevant.

We keep this information to the minimum needed, store it securely, restrict who can access it, and do not share it with third parties for marketing. You can withdraw your consent and ask us to delete this information at any time (see section 9).

6. Who we share your data with

We do not sell your personal data. We share it only with trusted service providers who help us run our business, and only as far as necessary. These may include:

  • SCHEDULING / BOOKING TOOL — Calendly, TidyCal — to manage bookings.

  • ANALYTICS PROVIDER — Google Analytics — to understand how the Site is used.

  • WEBSITE HOST / PLATFORM — e.g. Squarespace — to host and run the Site.

  • Professional advisers — such as our accountant, and IT or legal advisers where necessary.

These providers act on our instructions and are themselves required to keep your data secure. We may also disclose your data where required to do so by law.

7. International transfers

Some of our service providers (for example, email or analytics providers) may store or process data outside the UK and European Economic Area (EEA). Where they do, we make sure appropriate safeguards are in place — such as the UK International Data Transfer Agreement, the EU Standard Contractual Clauses, or an equivalent approved mechanism — so that your data receives an equivalent level of protection.

8. Cookies and analytics

Our Site uses cookies and similar technologies. Some are necessary for the Site to work; others (such as analytics cookies) help us understand how visitors use the Site so we can improve it.

Non-essential cookies are only set with your consent, which you can give or withdraw through our cookie banner or your browser settings. You can also set your browser to refuse cookies, though some parts of the Site may not work as intended.

[If you have a separate, more detailed Cookie Policy, link to it here.]

9. Your rights

Under UK and EU data protection law you have the right to:

  • Be informed about how your data is used (this policy).

  • Access the personal data we hold about you.

  • Rectification — ask us to correct data that is inaccurate or incomplete.

  • Erasure — ask us to delete your data in certain circumstances ("right to be forgotten").

  • Restrict or object to our processing in certain circumstances.

  • Data portability — ask us to transfer your data to you or another provider.

  • Withdraw consent at any time where we rely on consent (for example, to unsubscribe from emails or withdraw consent to hold sensitive information).

To exercise any of these rights, contact us at hello@beyondthelabel.online. We will respond within one month. Exercising your rights is free unless your request is clearly unfounded or excessive.

You can unsubscribe from marketing emails at any time using the link in any email we send.

10. How long we keep your data

We keep your personal data only for as long as we need it:

  • Enquiries that don't become a relationship: up to 12 months, then deleted.

  • Coaching/training client records (including any sensitive information): for the duration of our work together and for three years afterwards, in line with our professional and insurance obligations.

  • Financial records: for 6 years as required by tax law.

  • Mailing list: until you unsubscribe or ask us to remove you.

11. How we protect your data

We take appropriate technical and organisational measures to keep your data secure — including restricting access, using secure and reputable service providers, and protecting our devices and accounts. No method of transmission over the internet is completely secure, but we take reasonable steps to protect your information.

12. Children's privacy

Our Site and services are intended for adults. We do not knowingly collect personal data from children under 16 without appropriate consent. If you believe we have collected data from a child, please contact us and we will delete it.

13. Changes to this policy

We may update this policy from time to time. The "Last updated" date at the top shows when it was last changed. Where changes are significant, we will take reasonable steps to let you know.

14. How to complain

If you have a concern about how we handle your data, please contact us first at hello@beyondthelabel.online and we will do our best to resolve it.

You also have the right to complain to the relevant supervisory authority:

  • In the UK: the Information Commissioner's Office (ICO) — www.ico.org.uk, helpline 0303 123 1113.

  • In the EU: your local data protection authority.
